Court seeks government, police’s response on Shanno’s death
New Delhi, May 4 The Delhi High Court Monday asked the central government and Delhi Police to respond on a petition seeking filing of a formal complaint against a school teacher for allegedly meting out corporal punishment to 11-year-old Shanno, who died last month.
The action came in response to a petition filed by the girl’s father, seeking action against the teacher.
Justice G.S. Sistani also sought the views of Delhi’s Chief Secretary and the education directorate, asking them to respond by May 14, the next date of hearing.
In the petition, Shanno’s father I.U. Khan pleaded that the court ask the police to register the first information report (FIR) under Section 304 (culpable homicide not amounting to murder) of the Indian Penal Code (IPC).
So far, police have registered a case under section 304 A (causing death by negligent act).
The petition contended that the teacher should be booked under the relevant provisions of law because she owed moral responsibility and legal obligation to protect any student.
Shanno, a student of a government school in Delhi, slipped into a coma April 15 and died two days after she was allegedly punished by her teacher. She was allegedly made to stand in the sun for two hours with bricks on her shoulders.
